1. Definitions

In these conditions “CCE” means Classic Car Engines Ltd.  “Buyer” means the party who accepts a quotation from CCE for the supply of goods.  “Goods” means the goods (including any installment of the goods or any part of them) which CCE is to supply in accordance with this contract.  “Contract” means the contract for the purchase and sale of the goods.

2. Conditions

2.1  These conditions shall form the contract between CCE and the buyer. Notwithstanding anything to the contrary in the buyers standard conditions of purchase, these conditions shall apply except so far as expressly agreed in writing by the office of CCE. No servant or agent of CCE has the power to vary these conditions orally or to make representations or promises about the condition of the goods, their fitness for any purpose or any other matter whatsoever.

2.2  Any advice or recommendation given by CCE or it’s servants or agents to the Buyer or it’s employees or agents as to the storage, application or use which is not confirmed in writing by CCE is followed or acted upon entirely at the Buyers own risk and accordingly CCE shall not be liable for any such advice or recommendation which is not so confirmed.

2.3  Any typographical, clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other documentation or information issued by CCE shall be subject to correction without any liability on the part of CCE.

Warranties and liability

3.1  Subject to the conditions set out below, CCE warrants that at the time of delivery the Goods shall correspond with their specification and will be free from defects in material relating to new parts only, workmanship, and that all services have been undertaken in accordance with the appropriate industry standards.

3.2  The following warranty is given by CCE subject to the following conditions:

CCE shall be under no liability in respect of any defect arising from fair wear and tear, willful damage, negligence, abnormal working conditions, failure to follow CCE’s instructions (whether written or oral) misuse, or alteration or repair of the goods without CCE’s approval.

The warranty does not extend to parts, materials or equipment not manufactured by CCE, in respect of which the buyer shall only be entitled to the benefit of such warranty or guarantee as is given by the manufacturer to CCE.

All engines fully restored by CCE with the exception of race/competition engines shall carry a 12 month or 12,000 miles warranty, whichever is the sooner AS TO NEW PARTS AND LABOUR ONLY.  FAILURE OF ORIGINAL CASTINGS, THREADS OR PARTS IS EXCLUDED FROM ANY WARRANTY. This warranty is invalid under any of the following circumstances:

If the engine is fitted incorrectly. If worn ancillaries, hoses, belts, inadequate radiator are used.  If cylinder head nuts are not re-torqued to correct setting after initial running, at 500 miles and 1,000 miles.  If good quality engine oil is not used and changed at 500 miles. If the engine is revved above 4,000 rpm during the 1st 1,000 miles. If the engine is modified or otherwise not as it was when supplied by CCE.

CCE is not responsible for the costs of removal or refitting of the engine under any circumstances.

The validity and performance of the Contract and these conditions shall be governed by the laws of England and subject to the jurisdiction of the English Courts.
